Quick question.

Can either player choose a Waterway (say Sea or Lake) if that feature is in the Defender's list of permitted terrain?

It is not dependent on whether or not you bring naval elements etc.

  Defender can only choose if it's compulsory for the defender.

  Invader can choose if a WW is available for both armies

  Unless you have a compulsory WW or sea there is no point in taking naval units (except boats that can go on rivers)

  If you have access to water and invade, you cant use them unless the country you invade has a WW or sea. If you defend you still cant use your navy as the invading army might not choose to invade along the water.

  You are right, Peter. The choice of sea or waterway is dependent on the permitted terrain. It is not dependent on having chosen to include naval elements in your specific army list.
